Recent Supreme Court Activity

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. Since our last update, three response briefs have been filed by parties opposing President Trump’s tariffs along with two amicus briefs in favor of the Federal Circuit’s judgment. Three new petitions have also been filed: one comes in a trademark case, another comes in a case addressing claims under the Quiet Title Act, and the third comes in a military disability retirement benefits case. Two waivers of the right to respond to petitions were filed in the same patent case, along with two amicus briefs favoring review. Two reply briefs were filed in another patent case. Finally, the Supreme Court rejected three petitions, one in a patent case and two in pro se cases. Here are the details.

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. Since our last update, there is no new activity in granted cases. With respect to petitions, four new petitions have been filed. Two petitions present questions related to Federal Circuit Rule 36, while two were filed in pro se cases. Opinions & Orders – September 12, 2025

Late yesterday, the Federal Circuit released a nonprecedential order dismissing an appeal. This morning the Federal Circuit released two nonprecedential opinions and five nonprecedential orders. Both opinions come in patent cases. One of the orders dismisses an appeal, while the other orders come in appeals from the Patent and Trademark Office and the Merit Systems Protection Board. Opinions & Orders – September 5, 2025

This morning, the Federal Circuit released four nonprecedential opinions, a nonprecedential order, and three Rule 36 judgments. All four of the opinions are per curiam and come in pro se cases. Two of the opinions come in appeals from the Merit Systems Protection Board; one is an appeal from the Patent and Trademark Office; and one is an appeal from the Court of Appeals for Veterans Claims. The nonprecedential order summarily affirms a district court decision in a patent case. Late Friday, the Federal Circuit released two nonprecedential orders, one dismissing an appeal and one affirming a district court and remanding in light of the Supreme Court’s reversal of the Federal Circuit’s judgment. This morning, the Federal Circuit released a nonprecedential opinion affirming a decision of the Patent Trial and Appeal Board. The court also released a nonprecedential order dismissing a petition for review of a decision of the Merit Systems Protection Board. This morning, the Federal Circuit released four nonprecedential opinions. Two arose from challenges to decisions of the Merit Systems Protection Board. One came in a pro se appeal from a decision of the Court of Federal Claims. The final opinion addressed an appeal from a decision of the Court of Appeals for Veterans Claims. The Federal Circuit also released one Rule 36 summary affirmance, three nonprecedential orders dismissing appeals, and one nonprecedential order granting summary affirmance. Late yesterday, the Federal Circuit released two nonprecedential orders, one sua sponte vacating a preliminary injunction and the other dismissing an appeal. This morning, the Federal Circuit released a precedential order denying a petition for a writ of mandamus seeking to transfer a case out of the Marshall Division of the Eastern District of Texas to the Sherman Division of the Eastern District of Texas; four nonprecedential opinions in pro se cases; two nonprecedential orders dismissing appeals; and two summary affirmances.
