Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. With respect to granted cases, there is no new activity to report since our last update. With respect to petitions, one new petition was filed in a Tucker Act case asking the Court to consider questions related to alleged federal government payment obligations. Also, an amicus brief in support of a petition was filed in a patent case, and a waiver of right to respond was filed in a pro se case. Here are the details.

This morning, the Federal Circuit released a precedential opinion in an employment case. In it, the court vacated and remanded an arbitrator’s decision to remove the plaintiff from the Federal Bureau of Prisons. Late yesterday and this morning, the court also released three nonprecedential orders, one transferring a case to a district court, one dismissing an appeal for untimeliness, and another also dismissing an appeal. Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. The Court granted the petition for certiorari in Rudisill v. McDonough, a veterans case raising a question related to GI Bill educational assistance. With respect to petitions, two new petitions were filed, one in a patent and one in a pro se case; a brief in opposition was filed in a patent case concerning inter partes review estoppel; and the Court denied petitions in two patent cases and five pro se cases. This morning, the Federal Circuit released a precedential opinion and a nonprecedential opinion in two cases appealed from the Merit Systems Protection Board. The court also released five nonprecedential orders, which included three summary affirmances and two dismissals. Here are the introductions of the opinion and links to the orders.

Today the Federal Circuit released two nonprecedential opinions and three nonprecedential orders. The first opinion affirms a judgment of the Patent Trial and Appeal Board, and the second affirms a judgment of the Western District of Texas in a patent case. This morning the Federal Circuit released a precedential order in a veterans case denying a combined petition for panel rehearing and rehearing en banc. Notably, Judge Dyk filed an opinion dissenting from the denial of the petition for rehearing en banc, and four other judges joined his opinion. The Federal Circuit also released three nonprecedential opinions, the first in a case appealed from the Court of Federal Claims; the second in a patent case addressing patent eligibility appealed from the District of Massachusetts; and the third in another patent case involving the same patent and appealed from the Northern District of California. This morning the Federal Circuit released a precedential opinion in a patent case appealed from the Southern District of California. In its opinion, the Federal Circuit reversed a district court’s claim construction, vacated its grant of summary judgment, and remanded the case. The Federal Circuit also released five nonprecedential orders late yesterday and this morning. Three grant motions to voluntarily dismiss appeals, and two dismiss appeals for failure to prosecute. Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. With respect to granted cases, the Supreme Court heard arguments this week in George v. McDonough, a case addressing veterans law. While no new petitions have been filed, the Court invited the Solicitor General to file a brief expressing the views of the United States in a case concerning patent law’s enablement requirement. Additionally, two waivers of right to respond and a reply brief were filed in other patent cases. Moreover, two amicus briefs were submitted this past week: one in a patent case raising questions related to enhanced damages and one in a veterans case involving the Equal Access to Justice Act.
