This morning the Federal Circuit released one precedential opinion and one nonprecedential opinion. The precedential opinion addresses an appeal from the United States Court of International Trade in an antidumping duty investigation. Recent Supreme Court Activity
Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. With respect to granted cases, an amicus brief was filed in support of respondent in Vidal v. Elster. With respect to petitions, two new petitions in two pro se cases were filed with the Court. Argument Preview – Darby Development Co. v. United States
Two cases being argued in September at the Federal Circuit attracted amicus briefs. One of these cases is Darby Development Co. v. United States. In this case, the Federal Circuit will review a decision by the Court of Federal Claims granting the government’s motion to dismiss physical takings and illegal exaction claims related to the Center for Disease Control’s eviction moratorium enacted during the onset of the COVID-19 pandemic. Late yesterday, the Federal Circuit released three nonprecedential orders dismissing appeals. One dismissal was agreed upon by the parties. The opinion discusses why the court affirmed the invalidation of numerous claims of three patents for obviousness. The court also released a summary affirmance under Federal Circuit Rule 36 and a nonprecedential order dismissing an appeal.
