This morning, the Federal Circuit released a precedential order and three nonprecedential opinions. The order grants a petition for initial hearing en banc in a case originally decided by the Merit Systems Protection Board. One of the opinions comes in a patent case appealed form the District of New Jersey, one comes in a veterans case appealed from the Court of Appeals for Veterans Claims, and one comes in response to a petition for review of a decision of the Merit Systems Protection Board. This morning, the Federal Circuit released one precedential opinion, one nonprecedential opinion, and one nonprecedential order dismissing an appeal. The precedential opinion comes in an appeal of a denial of a petition for rulemaking to establish criteria to limit the authority of the Patent and Trademark Office to institute inter partes or post-grant review under the America Invents Act. The nonprecedential opinion comes in an appeal from a series of inter partes review proceedings decided by the Patent Trial and Appeal Board. Last week we provided a preview of the 27 petitions distributed for the Supreme Court’s October 1 conference in cases decided by the Federal Circuit. Here is a report on the order list the Supreme Court issued today as a result of its October 1 conference. In a nutshell, the Court denied or dismissed petitions for certiorari in 21 cases decided by the Federal Circuit, and left six other petitions pending.
