In this blog post, I discuss Court of Federal Claims/Tucker Act decisions by the Federal Circuit on (1) the requirement of a money-mandating statute for statutory-based money claims, (2) whether a money-mandating requirement applies as well to claims to recover illegal exactions, (3) the special case of a breach of trust claim under the Indian Tucker Act, and (4) the continued availability of a Tucker Act taking claim even when a claim could alternatively be framed in tort. These 2020 Federal Circuit decisions affirmed the continued stability of Court of Federal Claims jurisdiction through careful application and welcome clarification and extension of established and common-sense Tucker Act doctrines.

Here is this month’s update on activity in cases pending before panels of the Federal Circuit where the cases involve at least one amicus brief. We keep track of these patent cases in the “Other Cases” section of our blog. Today, with respect to these cases we highlight two dispositions, three new cases that attracted amicus briefs, two recent oral arguments, and one upcoming oral argument.

On Friday, the Federal Circuit issued its opinion in Sanford Health Plan v. United States, a case we have been tracking because it attracted amicus briefs. In the opinion, a panel composed of Judges Dyk, Bryson, and Taranto unanimously affirmed the judgment of the Court of Federal Claims that the Affordable Care Act “provision on reimbursement of cost-sharing reductions is ‘money-mandating’ and that the government is liable for money damages for its failure to make reimbursements for the 2017 reductions.” Here is a summary of the opinion.

This morning the Federal Circuit issued two precedential opinions in Tucker Act cases and one nonprecedential order denying a writ of mandamus. Here are the introductions to the opinions and text from the order.

Here is this month’s update on activity in cases pending before panels of the Federal Circuit where the cases involve at least one amicus brief. Today, with respect to these cases we highlight one disposition, one new case, two recent oral arguments, and one upcoming oral argument.

Last week the Federal Circuit heard three cases that attracted amicus briefs. In one of these three cases, Sanford Health Plan v. United States, the United States presented two questions to the Federal Circuit related to the Affordable Care Act. As we noted in our argument preview, these questions ask whether health insurance companies may recover cost-sharing payments identified in the ACA but never funded by Congress. Last Thursday, the United States, Sanford Health Plan, and third party Community Health Plan (whose case was consolidated with Sanford for the oral argument) presented their arguments to a panel of the court that included Judges Dyk, Bryson, and Taranto. Here is a report on recent news and commentary related to the Federal Circuit and its cases. Today’s report highlights the Supreme Court’s rejection of the petition in Athena Diagnostics, Inc. v. Mayo Collaborative Services, LLC and oral arguments heard by the Federal Circuit in Sanford Health Plan v. United States and American Institute for International Steel v. United States.

Tomorrow the Federal Circuit will hear oral argument in Sanford Health Plan v. United States, a case presenting the question of whether health insurance companies may recover cost-sharing payments identified in the Affordable Care Act but never funded by Congress. Here is our argument preview.

This week (and on Monday and Tuesday next week) the Federal Circuit will hold 17 panel hearings and hear oral arguments in about 53 cases. Amicus briefs were filed in three of these cases. The first is a patent case drawing attention because of a challenge to the district court’s prevailing party determination, a prerequisite for attorney fee awards. The second is a sister case to three cases argued at the Supreme Court last month, Maine, Moda, and Land of Lincoln. And the third case, which presents a challenge to the delegation of power to the President to impose tariffs on steel products, saw two amicus briefs supporting the challenger and two supporting the government.
