Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. In the only pending case, a patent case addressing inducement of infringement and so-called skinny-labeling, there has been no new activity since our last update. As for pending petitions, since our last update, one new petition was filed in a veterans benefits case; two waivers of the right to respond to petitions were filed in a patent case and a case addressing Federal Circuit Rule 36; a brief in opposition was filed in a government contracts case; and the Supreme Court denied petitions in a patent case, a trademark case, and three pro se cases. As for pending petitions, since our last update, five new petitions were filed in a patent case, another patent case addressing sanctions, a veterans disability benefits case, a government contracts case, and a pro se case; three waivers of the right to respond to petitions were filed in a patent case and two pro se cases; a reply brief was filed in trademark case; two amicus briefs were filed in a patent case and Trade Act case; and the Supreme Court denied petitions in a patent case and two pro se cases. Here is an update on recent en banc activity at the Federal Circuit. Since our last update, the Federal Circuit issued an en banc opinion in a case addressing federal employment law. There also have been four new petitions for en banc rehearing asking questions related to contract interpretation, standing, prior art, and sanctions and fee awards. The Federal Circuit also denied three petitions for en banc rehearing in patent cases. Here are the details.

Since our last update, one new petition for en banc rehearing was filed, raising questions related to claim construction, patent eligibility, and appellate procedure. The court also denied four petitions for en banc rehearing. Those petitions raised questions related to the presumption of validity and the written description requirement, Rule 36, attorneys’ fees, and obviousness, and claim construction. Late yesterday, the Federal Circuit released two nonprecedential orders vacating and remanding cases decided by the Merit Systems Protection Board. This morning, the Federal Circuit released one precedential opinion in a case appealed from the Court of Appeals for Veterans Claims. The court also released three nonprecedential opinions. Two came in patent cases appealed from the Patent Trial and Appeal Board and the Northern District of California. The third came in a case appealed from the Merit Systems Protection Board. This morning, the Federal Circuit issued a precedential opinion in a patent case addressing patent eligibility and a precedential opinion in a veterans case involving a denial of duplicative educational benefits.
