Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. There are currently no pending cases previously decided by the Federal Circuit. As for pending petitions, since our last update, three new petitions were filed in a patent case and two pro se cases. Here are the details.
New Petitions
Since our last update, three new petitions have been filed in cases decided by the Federal Circuit.
Tesla, Inc. v. Granite Vehicle Ventures LLC
In this patent case, Tesla filed a petition asking the Court to review the following question:
- “Whether courts have power to review a PTO decision denying inter partes review on grounds that are contrary to statute, like an extra-statutory restriction based on time to trial in separate litigation.”
Gaylord v. United States
In this pro se case, Gaylord filed a petition with the Court presenting the following questions:
- Whether the “Department of the [A]rmy fail[ed] to provide the mandatory . . . full and fair hearing . . . [r]equired by 10 U.S.C 1214, based upon an official government record.”
- “[Whether] the government violates the due process clause and 10 U.S.C 1214 when . . . the [A]rmy is required to pay all retired pay [and] 10 U.S.C 1214 requires a full and fair hearing. The Government'[s] own record admits that there should be retired pay, and retired pay due, and retroactive pay due.”
- “The Secretary of the US Army may retire a service member with retired pay, when an injury or disease incurred during active military. The disease that occurred was discrimination, so this was not the result of my willful misconduct. [Whether] [p]unitive discharge is thereafter unlawfully executed.”
Lopez v. Collins
In this pro se case, Lopez filed a petition presenting three questions.
