Here is an update on recent en banc activity at the Federal Circuit in patent cases. Since our last update, one new petition for en banc rehearing was filed in a pro se case raising a question related to access to the lower court’s electronic filing system. Here are the details.
New Petition
In In re Kabir, a pro se litigant asked the court to review the following question:
- “Whether a district court’s refusal to grant a pro se litigant CM/ECF access, while mandating a secondary, delayed ‘ADS’ or paper-filing system, creates a ‘Procedural Asymmetry’ that violates the principle of equal access to the court under the law.”
