This morning the Federal Circuit issued two nonprecedential orders. The first denies a petition for a writ of mandamus against the Northern District of California seeking to order the district court to dismiss the case for lack of jurisdiction. The second denies a petition for a writ of mandamus challenging a discovery order in the District of Delaware. The Federal Circuit also issued a nonprecedential order late in the day yesterday granting a voluntary dismissal. Here are the introductions to the orders.

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. With respect to the Supreme Court’s October 2021 term, which began this week, the Court still has not granted any petitions in cases decided by the Federal Circuit. Since our last update, however, two new petitions have been filed with the Court: one in a veterans case and one filed by a pro se petitioner. As for previously filed petitions, one brief in opposition and two waivers of right to respond were filed. Finally, the Court denied 22 petitions following its first conference of the new term. Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. Last week the Supreme Court completed its October 2020 term, with all cases from the term decided. As for the Court’s October 2021 term, currently the Court has not granted any petitions in cases decided by the Federal Circuit. That said, many petitions are still pending. And, you may recall, the Court previously requested the views of the Solicitor General in American Axle & Manufacturing, Inc. v. Neapco Holdings LLC, a patent case presenting questions related to eligibility. We are still waiting for the government’s brief in that case. And since our last update, one new petition was filed in a patent case, two respondents submitted waivers of right to respond in a patent case and a pro se case, and a petitioner filed a reply brief in a vaccine case. Here is this month’s update on activity in cases pending before panels of the Federal Circuit where the cases involve at least one amicus brief. • 2G or Not 2G: Patent License Applies to Future Generation Wireless Networks – Despite Evolved Wireless’s efforts to limit a licensing agreement for a cellular network patent to 3G Networks, the Federal Circuit affirmed the lower court’s decision to give “generation” a broad construction.
• Apple, AT&T, Verizon Keep Patent Validity Suits in California – VoIP-Pal.com was unable to convince the Federal Circuit to issue a writ of mandamus directing the Northern District of California to transfer its cases to the Western District of Texas.
• Federal Circuit Says PTAB Wrongly Upheld Cancer Detection Patent – The Federal Circuit overruled the PTAB’s finding of no invalidity of Melanoscan’s patent in Canfield Scientific, Inc. v. Melanoscan, LLC.

Last week, the Federal Circuit decided In re VoIP-Pal.com, Inc., a patent case we have been tracking because it attracted an amicus brief. Judge Moore authored a unanimous panel opinion denying VoIP-Pal’s petition for a writ of mandamus. The panel found that the district court did not clearly abuse its discretion by declining to dismiss the case based on the first-to-file rule. This is our opinion summary.

This morning, the Federal Circuit issued a precedential opinion in a patent case, a nonprecedential opinion in a government contracts case, and a nonprecedential opinion in a patent case. The court also issued a nonprecedential order in a patent case denying a petition for a writ of mandamus that would have directed the Northern District of California to vacate an order denying a motion to dismiss based on the first-to-file doctrine. Here is an update on recent en banc activity at the Federal Circuit. The en banc court will hear oral argument tomorrow in a veterans case. As for patent cases, highlights include new petitions questions related to inter partes review, enablement, and eligible subject matter; a new response to a petition raising questions related to the intersection of inducement of infringement and Hatch-Waxman; and the denial of three petitions raising questions related to eligible subject matter, enablement, the intersection of venue and Hatch-Waxman, and the presumption of validity.
