Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. With respect to granted cases, there is no new activity to report since our last update. With respect to petitions, two new petitions were filed with the Court in a takings case and a pro se case; the government waived its right to respond in a pro se case and a veterans case; and three amicus briefs were filed in a takings case and a patent case. Opinions & Orders – August 9, 2022
This morning the Federal Circuit released a precedential opinion in a case appealed from the Merit Systems Protection Board and a nonprecedential opinion in a case appealed from the Court of Federal Claims. The Federal Circuit also released two nonprecedential orders. One denies a writ of mandamus seeking disqualification of the district court judge; one denies a writ of mandamus to transfer an appeal from the Western District of Texas to the District of Massachusetts. This morning the Federal Circuit released a nonprecedential opinion in a patent case appealed from the Patent Trial and Appeal Board. The court also released four nonprecedential orders. Two summarily affirm; one grants a transfer to the Middle District of Georgia; and one grants a motion to dismiss an appeal for lack of jurisdiction. This morning the Federal Circuit released nonprecedential opinions in two cases appealed from the Court of Federal Claims. In both cases, the Federal Circuit affirms a dismissal for lack of subject matter jurisdiction. Notably, both cases involve the same plaintiff. Here are the introductions to the opinions.
Argument Recap – Doyon v. United States
Earlier this month, the Federal Circuit heard oral argument in Doyon v. United States, a case in which Doyon appeals a judgment by the Court of Federal Claims upholding a decision by the Board for the Correction of Naval Records to deny an application to modify his discharge records. Three amicus briefs were filed by veterans organizations in support of Doyon. This is our argument recap.
