This morning, the Federal Circuit released three nonprecedential opinions: one in a patent case reviewing inter partes review decisions, one in another patent case addressing subject-matter jurisdiction, and one in a case appealed from the Merit Systems Protection Board. Opinions & Orders – December 22, 2022
This morning the Federal Circuit released a precedential opinion in a patent case appealed from the District of Delaware. In it, the Federal Circuit affirmed the district court’s holding that specific patent claims are unpatentable as obvious, the sale of a generic product would not induce infringement of the patents, and the sale of the generic product would not directly infringe other patents. Notably, Judge Newman dissented without opinion. The Federal Circuit also released two nonprecedential orders. One transfers an appeal to the Northern District of Georgia, and one denies a motion to dismiss and instead transfers an appeal to the Northern District of Ohio. This morning the Federal Circuit issued three nonprecedential opinions in patent cases appealed from the Western District of Wisconsin, the Central District of California, and the Patent Trial and Appeal Board, respectively. The court also issued seven nonprecedential orders this morning and late yesterday. One grants a motion to transfer venue; two deny motions to transfer venue; two dismiss cases for lack of jurisdiction; and two grant voluntary dismissals. This morning the Federal Circuit released four precedential opinions. The first comes in a government contract case appealed from the Civilian Board of Contract Appeals.
