Recent Supreme Court Activity

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. There are currently no pending cases previously decided by the Federal Circuit. As for pending petitions, since our last update, four new petitions were filed in a patent case, a case originally decided by the Merit Systems Protection Board, and two pro se cases, and four waivers of the right to respond to petitions were filed in a patent case and three pro se cases. This morning, the Federal Circuit released two nonprecedential opinions, one nonprecedential order granting a summary affirmance, and two nonprecedential orders dismissing appeals. The opinions come in a case appealed from the Trademark Trial and Appeal Board and a case appealed from the Merit Systems Protection Board, respectively. Opinions & Orders – April 29, 2022

This morning the Federal Circuit released two precedential opinions in patent cases. The first comes in an appeal from the Patent Trial and Appeal Board, and the court vacates and remands the Board’s decision over a dissent by Judge Reyna.
