Late yesterday, the Federal Circuit released a precedential opinion in an en banc case appealed from the Western District of Texas. Notably, Judges Reyna and Stark concurred in part and dissented in part. Today, the Federal Circuit released a precedential opinion in a trademark case. The court also released three nonprecedential opinions affirming judgments, the first in a veterans case, the second in a patent case, and the third in an appeal from the Armed Services Board of Contract Appeals. Opinions & Orders – May 19, 2025

Today, the Federal Circuit released three nonprecedential opinions. In the first, the court affirmed as to a direct appeal and reversed as to a cross-appeal in a patent case. Notably, Judge Stark dissented in part from the majority’s decision to reverse as to the cross-appeal. In the second nonprecedential opinion, the court affirmed a decision of the Court of Appeals for Veterans Claims. In the third nonprecedential opinion, the Federal Circuit vacated and remanded a decision of the Trademark Trial and Appeal Board. The Federal Circuit also released one nonprecedential order granting a motion for summary affirmance and three nonprecedential orders dismissing appeals. Opinions & Orders – May 14, 2025

Today, the Federal Circuit released three nonprecedential opinions in two veterans cases and a case appealed from the Merit Systems Protection Board. In the first veterans case, the court affirmed a dismissal. In the second veterans case, the court affirmed in part and dismissed in part a decision denying an earlier effective date for a service-connected condition. In the case appealed form the Merit Systems Protection Board, the court affirmed the dismissal of an appeal for lack of jurisdiction. Here are the introductions to the opinions.

Update on Important Panel Activity

Here is an update on activity in cases pending before panels of the Federal Circuit where the case involves at least one amicus brief. We keep track of these cases in the “Other Cases” section of our blog. Today with respect to these cases we highlight three new opinions, one in a case related to the rulemaking authority of the Department of Veterans Affairs, another in a takings case related to water rights, and another related to patents alleged to be improperly listed in the FDA’s Orange Book. Opinion Summary – Metropolitan Area EMS Authority v. Secretary of Veterans Affairs

The Federal Circuit issued its opinion earlier this month in Metropolitan Area EMS Authority v. Secretary of Veterans Affairs, a veterans case we have been following because it attracted an amicus brief. In this case, the Federal Circuit reviewed a rule promulgated by the Secretary of Veterans Affairs that permitted VA to pay the lesser of the actual charge or the Medicare fee schedule (MFS) amount for all non-contract ground and air ambulance transports. The petitioners in this case sought review of this rule. In an opinion authored by Judge Stoll and joined by Judges Lourie and Stark, the Federal Circuit granted the petition and set aside the rule as not in accordance with law given the governing statute. Opinions & Orders – December 9, 2024

This morning the Federal Circuit released four precedential opinions and three nonprecedential opinions. The first precedential opinion comes in a trade case and affirms in part, vacates in part, and remands the case to the Court of International Trade. Notably, Judge Stark concurred in part and dissenting in part from the majority’s judgment. The second precedential opinion comes in a case challenging a final rule of the Department of Veterans Affairs that changed how the VA pays for noncontract ground and air ambulance transports for eligible beneficiaries. The Federal Circuit set aside the final rule. The third precedential opinion comes in a patent case. In this third case the Federal Circuit affirmed a judgment of the District of Delaware over challenges to two of the lower court’s claim constructions. The fourth precedential opinion comes in a case dismissed by the Court of Appeals for Veterans Claims for lack of jurisdiction. All three of the nonprecedential opinions come in pro se appeals.
