Recent Supreme Activity

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. Since our last update, there has been no new activity at the Supreme Court in the only pending case decided by the Federal Circuit. As for petitions, a new petition was filed in a patent case addressing appellate procedure; waivers of the right to respond to petitions were filed in a patent case and five pro se cases; a reply brief in support of a petition was filed in a veterans case; and the Supreme Court denied petitions in ten cases. Recent Supreme Court Activity

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. Since our last update, there has been no new activity at the Supreme Court in the only pending case decided by the Federal Circuit. As for petitions, there has been a lot of activity:

  • eight new petitions were filed, one in a patent case and seven in pro se cases;
  • nine waivers of the right to respond to petitions were filed in patent cases, a veterans case, an MSPB case, a government contracts case, and pro se cases;
  • fourt briefs in opposition were filed in a Quiet Title Act case, a veterans case, and government contracts case;
  • three reply briefs in support of petitions were filed in the same Quiet Title Act case, a trademark case, and the same government contracts case;
  • sixteen amicus briefs have been filed two patent cases, a veterans case, and two takings cases;
  • supplemental briefs were filed in a patent case and a pro se case; and
  • the Supreme Court denied petitions in two patent cases, a takings case, a case addressing jurisdiction and a pro se case.

Opinions & Orders – December 17, 2025

Late yesterday, the Federal Circuit released two nonprecedential orders dismissing appeals. This morning, the court released two precedential opinions and five nonprecedential opinions. One of the precedential opinions comes in a patent infringement case and, notably, includes an opinion concurring-in-part and dissenting-in-part. The other precedential opinion comes in an appeal of a decision of the Merit Systems Protection Board. Three of the five nonprecedential opinions come in patent cases; one comes in an appeal from the Court of Appeals for Veterans Claims; and the other comes in an appeal of a decision of the Armed Services Board of Contract Appeals. As for pending petitions, new petitions were filed in a patent case, a government contract case, and a pro se case; briefs in opposition were filed in a patent case and a takings case; waivers of the right to respond to petitions were filed in a Rule 36 case and two pro se cases; five amicus briefs were filed in a government contract case; and three petitions were denied, one in a Rule 36 case and two in pro se cases. Late yesterday, the Federal Circuit released a precedential opinion in an en banc case appealed from the Western District of Texas. Notably, Judges Reyna and Stark concurred in part and dissented in part. Today, the Federal Circuit released a precedential opinion in a trademark case. The court also released three nonprecedential opinions affirming judgments, the first in a veterans case, the second in a patent case, and the third in an appeal from the Armed Services Board of Contract Appeals. Opinions & Orders – May 7, 2025

Today the Federal Circuit released four precedential opinions, a nonprecedential opinion, two summary affirmances, and a dismissal. Two of the precedential opinions comes in related patent cases. In the first opinion, the court dismisses an appeal from a decision of the Patent Trial and Appeal Board because the appellant did not have standing. Notably, Judge Hughes filed a concurring opinion. In the second opinion, the court reversed an order by the District of New Jersey granting a preliminary injunction. In the third precedential opinion the Federal Circuit affirmed a judgment of the District of Delaware in a patent case. In the fourth precedential opinion, the Federal Circuit affirmed a decision of the Trademark Trial and Appeal Board.
