This morning the Federal Circuit released two nonprecedential opinions and seven nonprecedential orders. The first opinion affirms a judgment of the Merit Systems Protection Board, and the second opinion affirms in part, reverses in part, and remands a patent and trade secret case appealed from the District of Rhode Island. This morning the Federal Circuit released one precedential opinion, one nonprecedential opinion, and three nonprecedential orders. The precedential opinion reverses a judgment of the U.S. Court of International Trade concerning the scope of an antidumping duty order. Notably, Judge Chen dissented. The nonprecedential opinion affirms the denial of a petition for a writ of mandamus by the Court of Appeals for Veterans Claims. The orders are all dismissals. This morning, the Federal Circuit released one precedential opinion, two nonprecedential opinions, and six nonprecedential orders. The precedential opinion, which attracted two amicus briefs, addresses an appeal from a final judgment of a district court holding certain patent claims invalid as obvious. Judge Cunningham filed an opinion dissenting in part. One of the nonprecedential opinions affirms four final written decisions of the Patent Trial and Appeal Board, determining all claims are unpatentable over asserted prior art. The other nonprecedential opinion affirms a decision of the Merit Systems Protections Board. Two of the nonprecedential orders transfer appeals to other United States appellate courts. Opinions & Orders – December 14, 2023
On its website, today, the Federal Circuit did not release any opinions, but it did release eleven nonprecedential orders in various cases. (Judges Prost, Hughes, and Stoll were busy!) Other than an order granting a petition to transfer a patent case from the Western District of Texas to the Northern District of California, the orders are relatively run-of-the mill. They do things like dismiss petitions, summarily affirm, deny petitions, and grant undisputed motions to transfer, and dismissal appeals.
