Recent Supreme Court Activity

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. Since our last update, a new amicus brief was filed in President Trump’s case addressing his tariffs. Regarding pending petitions, one new petition was filed in a trademark case, a new amicus brief was filed in a patent case, two new waivers of the right to respond were filed in pro se cases, and thirteen petitions were denied by the Supreme Court in cases raising questions related to patent law, the Lanham Act, military disability retirement benefits, and due process. Recent En Banc Activity

Here is an update on recent en banc activity at the Federal Circuit in patent cases. Last week the Federal Circuit heard oral argument in one of the two pending en banc cases. With respect to pending petitions, two new petitions have been filed and the court denied one petition. One of the new petitions raises a question regarding claim construction; the other new petition raises a question concerning whether an abandoned patent application that becomes publicly available only after a challenged patent’s critical date is a printed publication that can be the basis for an inter partes review proceeding. Opinions & Orders – December 19, 2024

This morning the Federal Circuit released three nonprecedential opinions and six nonprecedential orders. The first opinion comes in a patent case appealed from a district court. Notably, Judge Bryson concurred in part and dissented in part. The other two opinions come in veterans cases. One of the orders comes in a pro se appeal, while all the other orders dismiss cases.
