Opinions & Orders – January 20, 2023

This morning the Federal Circuit released one precedential opinion and two nonprecedential opinions. The precedential opinion comes in a patent case appealed from the Eastern District of Texas. In it, the Federal Circuit affirmed the district court’s determination that a patent is unenforceable based on prosecution laches. Notably, Judge Stark filed a dissenting opinion. The two nonprecedential opinions come in separate patent cases appealed from the Patent Trial and Appeal, both involving the same parties. In each opinion, Judge Lourie filed additional views and Judge Stark filed a concurring opinion, both addressing the argument the Supreme Court overruled the Federal Circuit’s approach to obviousness with respect to design patents. Recent Supreme Court Activity

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. With respect to granted cases, there is no new activity to report since our last update. With respect to petitions, two new petitions were filed, both in pro se cases; the government waived its right to respond in two other pro se cases and a Merit Systems Protection Board case; the government filed a brief in opposition in a veterans case; three petitioners filed reply briefs in three takings cases; two amicus briefs were filed in a veterans case and one amicus brief was filed in a patent case concerning inter partes review estoppel; and, finally, the Court denied three petitions, one in a judicial disqualification case and two in pro se cases. Today, the Federal Circuit released two precedential opinions, one in a government contract case appealed from the Court of Federal Claims and one in a patent case appealed from the Patent Trial and Appeal Board. The Federal Circuit released four precedential opinions: a precedential opinion in a patent case decided by the Western District of Washington; two precedential opinions in cases addressing the Fair Labor Standards Act; and another precedential opinion addressing the Border Patrol Agent Pay Reform Act and Back Pay Act. Notably, in the latter three cases, Judge Reyna filed dissenting opinions. The court also released two nonprecedential opinions in cases involving the same appellant challenging decisions of the Merit Systems Protection Board, along with four orders dismissing appeals. Opinions & Orders – November 15, 2022

This morning the Federal Circuit released a precedential opinion in a patent case appealed from the Patent Trial and Appeal Board. In this opinion, the Federal Circuit affirms the Board’s decision that specific claims are unpatentable, reversed the Board’s construction of the phrase “used for electrical interconnection,” and remanded the case. The Federal Circuit also released three nonprecedential opinions. The first comes in a case appealed from the Merit Systems Protection Board; the second comes in a patent case appealed from the District of Delaware; and the third comes in a government contract case appealed from the Court of Federal Claims. Finally, the Federal Circuit released two nonprecedential orders. One transfers an appeal to the Court of Appeals for the Second Circuit, and one transfers an appeal to the District of Maryland.

This morning the Federal Circuit released two precedential opinions. The first comes in a patent case appealed from the District of Massachusetts. In this opinion, the Federal Circuit affirms the district court’s preliminary injunction order. The second comes in a case appealed from the Merit Systems Protection Board. In this opinion, the Federal Circuit affirms the Board’s removal of an employee of the Department of Defense. The Federal Circuit also released three nonprecedential opinions. The first and second come in veterans cases appealed from the Court of Appeals for Veterans Claims, and the third comes in a case appealed from the Merit Systems Protection Board. Finally, the Federal Circuit released a Rule 36 judgment and two nonprecedential orders. One of these orders summarily affirms, and one dismisses an appeal. This morning the Federal Circuit released two precedential opinions. The first comes in a patent case appealed from the Western District of Washington. In its opinion, the Federal Circuit affirms the district court’s invalidation of patent claims based on subject matter eligibility; notably, Judge Stoll dissented in part. The second comes in another patent case appealed from the Northern District of California. In this opinion, the Federal Circuit reverses the district court’s finding of invalidity based on indefiniteness; notably, Judge Dyk dissented.
