Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. Since our last update, a new amicus brief was filed in President Trump’s case addressing his tariffs. Regarding pending petitions, one new petition was filed in a trademark case, a new amicus brief was filed in a patent case, two new waivers of the right to respond were filed in pro se cases, and thirteen petitions were denied by the Supreme Court in cases raising questions related to patent law, the Lanham Act, military disability retirement benefits, and due process. This morning, the Federal Circuit released four nonprecedential opinions, a nonprecedential order, and three Rule 36 judgments. All four of the opinions are per curiam and come in pro se cases. Two of the opinions come in appeals from the Merit Systems Protection Board; one is an appeal from the Patent and Trademark Office; and one is an appeal from the Court of Appeals for Veterans Claims. The nonprecedential order summarily affirms a district court decision in a patent case. Recent En Banc Activity
Here is an update on recent en banc activity at the Federal Circuit in patent cases. Since our last update, the court issued an en banc opinion in a patent case. Additionally, two new en banc petitions were filed. The first raises claim construction questions and the second was filed pro se. The Federal Circuit also invited a response to a petition raising a question related to collateral estoppel, and a new response was filed in opposition to an en banc brief. Here is an update on recent en banc activity at the Federal Circuit. Since our last update, three new petitions have been filed, and two previously filed petitions have been denied. The first new petition raises a question related to Article III jurisdiction to adjudicate patent infringement when the patent has already expired; the second raises a question regarding whether a court can rule on a motion for summary judgment of invalidity of a patent after ruling that the plaintiffs lacked standing; and the third raises a question concerning collateral estoppel related to a decision of the Patent Trial and Appeal Board. This morning, the Federal Circuit released three precedential opinions, four nonprecedential opinions, and a nonprecedential order. Of the precedential opinions, two come in patent cases on appeal from the Patent Trial and Appeal Board and the Eastern District of Wisconsin, and the other comes in a takings case on appeal from the Court of Federal Claims. Of the nonprecedential opinions, two come in pro se appeals, one comes in a veterans case, and the other comes in a patent case on appeal from the Court of Federal Claims.
