Late yesterday, the Federal Circuit released four nonprecedential orders. One grants a motion to remand in a patent case appealed from the Patent Trial and Appeal Board, two dismiss appeals, and one dismisses a petition. This morning, the Court released one precedential opinion, two nonprecedential opinions, and four additional nonprecedential orders. The precedential opinion comes in a veterans case appealed from the Court of Appeals for Veterans Claims. One of the nonprecedential opinions comes in a tax case appealed from the Court of Federal Claims, and the other comes in a veterans case appealed from the Court of Appeals for Veterans Claims. Of the nonprecedential orders, one summarily affirms a case appealed from the Court of Federal Claims, two dismiss appeals, and one dismisses a petition. Recent Supreme Court Activity

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. In the only pending case, a patent case addressing inducement of infringement and so-called skinny-labeling, there has been no new activity since our last update. As for pending petitions, since our last update, one new petition was filed in a veterans benefits case; two waivers of the right to respond to petitions were filed in a patent case and a case addressing Federal Circuit Rule 36; a brief in opposition was filed in a government contracts case; and the Supreme Court denied petitions in a patent case, a trademark case, and three pro se cases. Opinions & Orders – February 25, 2026

This morning, the Federal Circuit released one nonprecedential opinion and two nonprecedential orders. The opinion comes in an appeal from a decision of the Patent Trial and Appeal Board, which found claims not unpatentable. Notably, Judge Dyk dissented. One of the orders denies a petition for a writ of mandamus seeking to order the Patent and Trademark Office to reconsider a petition for inter partes review without relying on consideration of “settled expectations.” The other order is a dismissal. Late yesterday, the Federal Circuit released a nonprecedential opinion in an appeal of a decision of the Merit Systems Protection Board. This morning, the Federal Circuit released two nonprecedential opinions, two nonprecedential orders, and an errata. One of the opinions comes in another appeal of a decision of the Merit Systems Protection Board; the other comes in an appeal of a decision of the Court of Appeals for Veterans Claims. Both orders deny petitions for writs of mandamus. One of the petitions sought to order the Merit Systems Protection Board to order discovery and sanction an agency. The other petition sought to order the Patent and Trademark Office to vacate a denial of its petition for inter partes review.
