This morning, the Federal Circuit released a precedential opinion in a pro se case appealed from the Court of Federal Claims. The Federal Circuit affirmed the lower court’s dismissal for lack of jurisdiction. The Federal Circuit also released a nonprecedential opinion in a patent case. Notably, Judge Dyk dissented in part. The court also released two other nonprecedential opinions, one in another case dismissed by the Court of Federal Claims for lack of jurisdiction and one in an appeal from a judgment of the Merit Systems Protection Board. This morning the Federal Circuit released two precedential opinions, one nonprecedential opinion, and two nonprecedential dismissals. One of the precedential opinions addresses an appeal from five final written decisions of the Patent Trial and Appeal Board. The other precedential opinion addresses an appeal from a grant of summary judgment of noninfringement in a patent infringement case. The nonprecedential opinion affirms an arbitrator’s decision in a dispute over removal from a role with the United States Marshals Service. Opinions & Orders – October 17, 2022

This morning the Federal Circuit released two precedential opinions. The first comes in a patent case appealed from the Western District of Washington. In its opinion, the Federal Circuit affirms the district court’s invalidation of patent claims based on subject matter eligibility; notably, Judge Stoll dissented in part. The second comes in another patent case appealed from the Northern District of California. In this opinion, the Federal Circuit reverses the district court’s finding of invalidity based on indefiniteness; notably, Judge Dyk dissented. The Federal Circuit also released three nonprecedential opinions. The first and second come in veterans cases appealed from the Court of Appeals for Veterans Claims; the third comes in a case appealed from the Merit Systems Protection Board.
