This morning, the Federal Circuit released five nonprecedential opinions and six nonprecedential orders. Two of the five opinions come in patent cases, one appealed from the Patent Trial and Appeal Board and one from a district court; two come in pro se appeals of decision of the Merit Systems Protection Board; and the fifth comes in a pro se appeal of a decision of the Court of Appeals for Veterans Claims. Two of the six orders deny petitions for writs of mandamus; two transfer appeals; another affirms a judgment; and one dismisses an appeal. The precedential opinion reverses and remands a judgment of the Court of Appeals for Veterans Claims. The first nonprecedential opinion affirms a judgment in a case appealed from the Patent Trial and Appeal Board, the second dismisses an appeal from the Court of Appeals for Veterans Claims, the third affirms the the Court of Federal Claims’s denial of a petition to review a Special Master’s dismissal of a claim under the Childhood Vaccine Injury Act, and the fourth affirms a judgment of the Court of Federal Claims concerning a veteran’s claims. This morning the Federal Circuit released a precedential opinion in a patent case appealed from the District of Delaware. In its opinion, the Federal Circuit affirmed the district court’s dismissal of a patent infringement complaint under the duplicative-litigation doctrine. The Federal Circuit also released three nonprecedential opinions. The first and second opinions come in veterans cases appealed from the Court of Appeals for Veterans Claims; the third comes in an employment case appealed from the Merit Systems Protection Board.
