Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. In the only pending case, a patent case addressing inducement of infringement and so-called skinny-labeling, there has been no new activity since our last update. As for pending petitions, since our last update, one new petition was filed in a veterans benefits case; two waivers of the right to respond to petitions were filed in a patent case and a case addressing Federal Circuit Rule 36; a brief in opposition was filed in a government contracts case; and the Supreme Court denied petitions in a patent case, a trademark case, and three pro se cases. Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. In the only pending case, a patent case addressing inducement of infringement and so-called skinny-labeling, seven amicus briefs were filed supporting the respondent. As for pending petitions, since our last update, five new petitions were filed in a patent case, another patent case addressing sanctions, a veterans disability benefits case, a government contracts case, and a pro se case; three waivers of the right to respond to petitions were filed in a patent case and two pro se cases; a reply brief was filed in trademark case; two amicus briefs were filed in a patent case and Trade Act case; and the Supreme Court denied petitions in a patent case and two pro se cases. Opinions & Orders – November 6, 2025
Late yesterday, the Federal Circuit released a nonprecedential order dismissing an appeal. This morning, the court released one precedential order, three nonprecedential opinions, four nonprecedential orders, and an errata. The precedential order comes in a petition for a writ of mandamus seeking to order the Director of the U.S. Patent and Trademark Office to vacate an order deinstituting an inter partes review proceeding. Two of the orders deny similar petitions of writs of mandamus. All three nonprecedential opinions come in pro se appeals, two from the Merit Systems Protection Board and one from the Court of Federal Claims. The remaining two orders dismiss appeals. Late Friday afternoon, the Federal Circuit released an errata. This morning, the Federal Circuit released two precedential opinions, three nonprecedential opinions, and four Rule 36 summary affirmances. Of the two precedential opinions, one comes in Tucker Act case and the other comes in a patent case. Of the nonprecedential opinions, one comes in a takings case, one in a veterans case, and the other is on appeal from the Merit Systems Protection Board. Yesterday afternoon the Federal Circuit released two nonprecedential orders, which were dismissals. This morning the Federal Circuit released five nonprecedential orders and two Rule 36 judgments. As for the nonprecedential opinions, the first comes in an appeal from the Patent Trial and Appeal Board and the second in an appeal from the International Trade Commission.
