Here is an update on activity in cases pending before panels of the Federal Circuit where the cases involve at least one amicus brief. Today with respect to these cases we highlight two new opinions in two patent cases and one new case that attracted an amicus brief in another patent case. Opinion Summary – Backertop Licensing LLC v. Canary Connect, Inc.

Earlier this month the Federal Circuit issued its opinion in Backertop Licensing LLC v. Canary Connect, Inc., a patent case that attracted an amicus brief. In this case the Federal Circuit reviewed a determination by the District of Delaware that an out-of-state non-party was in contempt of court for disregarding an order requiring her to testify at a hearing. The Federal Circuit, in an opinion authored by Judge Hughes that was joined by Judges Prost and Stoll, affirmed the contempt order of the district court. This is our opinion summary.

Opinions & Orders – July 16, 2024

This morning the Federal Circuit released one precedential opinion, four nonprecedential opinions, one nonprecedential order, and one Rule 36 judgment. The precedential opinion affirms a sua sponte order of the District of Delaware ordering a witness to appear in person for testimony regarding potential fraud on the court. The first nonprecedential opinion affirms in part and dismisses in part a judgment of the Court of Appeals for Veterans Claims. The second affirms a judgment of the District of Utah in a patent infringement case, while the third affirms a judgment of the Northern District of Georgia in a related case based on collateral estoppel. The fourth affirms a judgment of the Merit Systems Protection Board. The order is a denial of a petition for a writ of mandamus.
