Recent Supreme Court Activity

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. Since our last update, there has been no new activity at the Supreme Court in the only pending case decided by the Federal Circuit. As for petitions, there has been a lot of activity:

  • eight new petitions were filed, one in a patent case and seven in pro se cases;
  • nine waivers of the right to respond to petitions were filed in patent cases, a veterans case, an MSPB case, a government contracts case, and pro se cases;
  • fourt briefs in opposition were filed in a Quiet Title Act case, a veterans case, and government contracts case;
  • three reply briefs in support of petitions were filed in the same Quiet Title Act case, a trademark case, and the same government contracts case;
  • sixteen amicus briefs have been filed two patent cases, a veterans case, and two takings cases;
  • supplemental briefs were filed in a patent case and a pro se case; and
  • the Supreme Court denied petitions in two patent cases, a takings case, a case addressing jurisdiction and a pro se case.

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. Since our last update, we posted a recap of the oral argument in President Trump’s case pending at the Court. As for pending petitions, new petitions were filed in a patent case, a case originating at the Merit Systems Protection Board, and a pro se case; a reply brief was filed in support of a petition in a takings case; an amicus brief was filed in a trademark case; and the Court denied four petitions raising questions in two patent cases and two pro se cases. Opinions & Orders – June 11, 2025

Late yesterday, the Federal Circuit released three nonprecedential orders. As we separately noted, in one of these orders the en banc Federal Circuit stayed the Court of International Trade’s injunctions of President Trump’s tariffs. In yesterday’s other two nonprecedential orders, the court dismissed appeals. This morning, the Federal Circuit released one precedential opinion and one nonprecedential opinion. The precedential opinion comes in a patent case, in which the court affirmed two final written decisions of the Patent Trial and Appeal Board. In the nonprecedential opinion, the court dismissed a case appealed from the Merit Systems Protection Board. Opinions & Orders – January 6, 2023

This morning the Federal Circuit released a precedential opinion in a patent case appealed from the Patent Trial and Appeal Board. In it, the Federal Circuit affirmed the Board’s judgment in an interference proceeding. The Federal Circuit also released a nonprecedential opinion in another patent case appealed from the Patent Trial and Appeal Board. Notably, both patent cases involve the same parties. This morning the Federal Circuit issued a precedential order granting a petition for initial hearing en banc in a veterans case, one precedential order denying a motion to vacate and remand in light of Arthrex, one nonprecedential order unsealing a nonprecedential opinion in a patent case, the nonprecedential opinion in the patent case, another nonprecedential opinion in a case appealed from the Court of Federal Claims, and another nonprecedential opinion in a patent case.
