This morning the Federal Circuit released one nonprecedential opinion and three nonprecedential orders. The opinion affirms a decision of the Merit Systems Protection Board, which denied an application for disability retirement benefits. The first order denies a petition for a writ of mandamus seeking to order the Eastern District of Texas to vacate an order denying transfer and to transfer the case. Tracie Thurston appeals a decision of the Merit Systems Protection Board (Board) affirming the Office of Personnel Management’s (OPM) reconsideration decision denying her application for disability retirement benefits under the Federal Employee’s Retirement System (FERS). For the following reasons, we affirm.
In re Zepp Health Corp. (Nonprecedential Order)
Zepp Health Corp. petitions for a writ of mandamus directing the United States District Court for the Eastern District of Texas (“EDTX”) to vacate its order denying transfer and to transfer this action to the United States District Court for the Central District of California (“CDCA”). Slyde Analytics LLC opposes the petition.
In light of the evidence of record and arguments presented, we conclude that the district court did not clearly abuse its discretion in finding that Zepp failed to show that CDCA was clearly more convenient than EDTX. We therefore deny Zepp’s petition for a writ of mandamus.
