This morning the Federal Circuit released two nonprecedential opinions and five nonprecedential orders. The first opinion affirms a final decision of the Merit Systems Protection Board, which denied review and dismissed an appeal for lack of jurisdiction. The second opinion vacates and remands a judgment of the Armed Services Board of Contract Appeals in a government contract case. The orders are all dismissals. Sanders v. Merit Systems Protection Board (Nonprecedential)

Cecil Allen Sanders, Jr. appeals a final decision of the Merit Systems Protection Board (“Board”), denying review and dismissing his appeal for lack of jurisdiction. We affirm.

MPG West, LLC v. Secretary of Defense (Nonprecedential)

MPG West, LLC (“MPG”) appeals the decision of the Armed Services Board of Contract Appeals (“Board”) regarding its contract claims against the Defense Commissary Agency (“DeCA”). The Board erred in failing to determine whether the contract at issue required MPG to import bagged salads from the United States. For this reason, this court vacates the Board’s decision and remands the case to the Board for further proceedings. In other respects, we affirm.
