Here is an update on recent en banc activity at the Federal Circuit in patent cases, including a new petition related to the issue of patent eligibility.
New Petitions
A new en banc petition was filed in Bridge and Post, Inc. v. Verizon Communications, Inc. In its petition, Bridge and Post Inc. asked the en banc court to review the following question: Whether, in light of the Federal Circuit’s case law on the computer-related arts, “this Circuit’s application of the two-prong Alice test no longer accomplishes its sole purpose: to determine whether patent claims preempt others from using laws of nature, natural phenomena, or abstract ideas—the fundamental building blocks of innovation.”
