Opinions

This morning, the Federal Circuit released one nonprecedential opinion. It comes in a takings case appealed from the Court of Federal Claims. Here is the introduction to the opinion.

233rd Street Partnership v. United States (Nonprecedential)

Appellant 233rd Street Partnership, L.P., filed a Fifth Amendment taking claim seeking compensation for a federal taking effected by a Notice of Interim Trail Use under the authority of the National Trails System Act, 16 U.S.C. §§ 1241–49. On summary judgment, the Court of Federal Claims held that 233rd Street Partnership failed to show that it had an ownership interest in the property in dispute, and that its taking claim therefore failed as a matter of law. We agree with the trial court’s analysis and therefore affirm.
