Late Friday afternoon, the Federal Circuit released three nonprecedential orders dismissing appeals. This morning, the court released one precedential opinion and one nonprecedential order. Today’s opinion comes in a patent case appealed from the Patent Trial and Appeal Board. Today’s order denies a motion for leave to proceed in forma pauperis. Here are the introductions to today’s opinion and order, along with links to Friday’s dismissals.
Google LLC v. Valtrus Innovations Ltd. (Precedential)
Google LLC (“Google”) appeals a Final Written Decision of the Patent Trial and Appeal Board in IPR2022-01545 regarding U.S. Patent No. 6,728,704 (“the ’704 patent”). J.A. 1–44 (“Decision”). The Board determined that Google did not demonstrate that any of claims 1–23 of the ’704 patent are unpatentable. Decision at 41–42. For the reasons below, we affirm.
Ruth v. United States (Nonprecedential Order)
On August 11, 2026, the court denied Eber G. Ruth’s motion for leave to proceed in forma pauperis (“IFP”) in view of 28 U.S.C. § 1915(g)’s three-strike provision. Mr. Ruth has not paid the fee but moves for “liberal construction,” appearing to contend that § 1915 is “unlawfully stigmatizing.” ECF No. 12 at 1. To the extent Mr. Ruth seeks reconsideration of the court’s August 11, 2026 order, he fails to demonstrate any basis for reconsideration.
