Late yesterday, the Federal Circuit released a nonprecedential order dismissing an appeal. This morning the court released one nonprecedential opinion and one nonprecedential order. The opinion comes in response to a petition for review of regulations promulgated by the Department of Veterans Affairs. The order dismisses a petition. Latham v. Secretary of Veterans Affairs (Nonprecedential)
Benjamin Latham, a veteran of the U.S. Marine Corps, and Patricia Latham, his wife and caretaker, petition this court under 38 U.S.C. § 502 to review regulations promulgated by the Department of Veterans Affairs (“VA”). While the Lathams have standing to challenge the VA regulations, their contentions fail on the merits. Thus, we deny the petition.
