This morning, the Federal Circuit released one nonprecedential opinion and one nonprecedential order. The opinion comes in a patent case appealed from the District of Utah. The nonprecedential order remands a case to the Merit Systems Protection Board. Here are the introductions to the opinion and the order.

Clearplay, Inc. v. Dish Network LLC (Nonprecedential)

After a jury found that DISH Network L.L.C. (“DISH”) and Echostar Technologies LLC infringed patents owned by ClearPlay, Inc. (“ClearPlay”), and awarded ClearPlay damages, the United States District Court for the District of Utah granted Defendants-Appellees’ motion for judgment as a matter of law (“JMOL”). ClearPlay appealed. For the following reasons, we affirm.

Bernstein v. Merit Systems Protection Board (Nonprecedential Order)

The Merit Systems Protection Board moves to waive the requirements of Federal Circuit Rule 27(f) and to remand this case for the administrative judge to reconsider dismissal of Bryan Joseph Bernstein’s appeal. Mr. Bernstein opposes the motion.
