Opinions

This morning, the Federal Circuit released one nonprecedential opinion and four nonprecedential orders. The opinion comes in a pro se appeal from a decision of the Court of Federal Claims. Notably, Judge Cunningham concurred only in the result. One of the orders affirms a dismissal of a complaint by the Court of Federal Claims; another grants a motion to transfer an appeal; the final two dismiss appeals. Here are the introductions to the opinion and first two orders, along with links to the dismissals.

J.A.C. v. Secretary of Health and Human Service (Nonprecedential)

Pro se appellant J.A.C. appeals the United States Court of Federal Claims’ denial of his August 19, 2024 motion to seal in the proceedings below. We affirm in part and reverse in part and remand.

Parrott v. United States (Nonprecedential Order)

Joseph Parrott Sr. appeals from the final judgment of the United States Court of Federal Claims dismissing his complaint seeking relief relating to social security disability benefits, supplemental security income (SSI) overpayments, and alleged misconduct by the City of Jacksonville. The United States moves for summary affirmance. Mr. Parrott moves to “reopen record and remand for consideration of newly discovered evidence,” ECF No. 2-1 at 1, ECF No. 6; “to file unredacted exhibits under seal,” ECF No. 5 at 3; for an “order granting notice of agency non-response and authorizing further action,” id. at 13; and “to recognize protective filing dates,” ECF No. 7 at 4.

United States v. Dervishaj (Nonprecedential Order)

Redinel Dervishaj moves unopposed to transfer this appeal, from his criminal proceedings in the United States District Court for the Eastern District of New York, to the United States Court of Appeals for the Second Circuit, explaining that the “notice of appeal was inadvertently prepared on a form used to appeal” to this court. ECF No. 3 at 2.
