Late Friday, the Federal Circuit released two nonprecedential orders dismissing appeals. This morning, the court released one precedential opinion, one nonprecedential opinion, and another nonprecedential order dismissing an appeal. The precedential opinion comes in a patent infringement case, and the nonprecedential opinion comes in an appeal from a decision of the Patent Trial and Appeals Board. Aortic Innovations LLC v. Edwards Lifesciences Corp. (Precedential)

This appeal concerns devices for transcatheter aortic valve replacement, a procedure in which a prosthetic heart valve replaces a diseased aortic valve. Aortic Innovations LLC appeals from a stipulated judgment of non-infringement of four asserted patents from the U.S. District Court for the District of Delaware. Aortic argues that the district court’s construction of “outer frame,” on which the stipulated judgment of non-infringement was based, was erroneous. We agree with the district court’s construction and affirm the judgment as to three of the asserted patents at issue. As to the fourth asserted patent, we dismiss the appeal for lack of jurisdiction.

Pictometry Int’l Corp. v. Nearmap US, Inc. (Nonprecedential)

Pictometry International Corp. (“Pictometry”) appeals from a final written decision of the Patent Trial and Appeal Board (“Board”) in an inter partes review (“IPR”) of U.S. Patent No. 8,542,880 (“the ’880 patent”) determining all challenged claims unpatentable. For the reasons set forth below, we affirm.
