Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. Since our last update, two new petitions were filed. One petition addresses a former military member’s entitlement to disability retirement, while the other addresses the Lanham Act’s prohibition on misrepresentations. Here are the details.

New Petitions
Since our last update, two new petitions have been filed.
First, a petition was filed in Pipes v. United States. In this case, Pipes asks the Court to consider the following question:
- “Whether a military reservist, who was lawfully ordered to engage in remedial fitness training without pay and points, and suffered injury, was on inactive-duty training status while performing ordered military training within the meaning of 10 U.S.C. § 101(d)(7)(B) and, therefore, entitled to disability retirement.”
Second, a petition was filed in Crocs, Inc. v. Double Diamond Distribution, Ltd. In this case, Crocs asks the Court to review the following question:
- “Whether the Lanham Act’s prohibition on ‘misrepresent[ations]’ as to ‘nature, characteristics, [or] qualities’ extends to misrepresentations about the product’s intangible properties, like its patent status.”
