Late yesterday, the Federal Circuit released two nonprecedential orders, each dismissing an appeal. This morning, the Federal Circuit released one precedential opinion, three nonprecedential opinions, two nonprecedential orders, and a Rule 36 summary affirmance. The lone precedential opinion comes in a patent case on appeal from the Patent Trial and Appeal Board, the nonprecedential opinions all come in cases on appeal from the Merit Systems Protection Board, and both of the nonprecedential orders dismiss appeals. HD Silicon Solutions LLC (“HDSS”) appeals from a final written decision of the United States Patent and Trademark Office Patent Trial and Appeal Board (“the Board”) holding claims 1–7 and 9–17 of U.S. Patent 6,774,033 (“the ’033 patent”) unpatentable as obvious. Gonzalez v. Dept. of Agriculture (Nonprecedential)
Joey D. Gonzalez petitions for review of a decision of the Merit Systems Protection Board (“Board”) affirming the Department of Agriculture’s (“Agency”) termination of Mr. Gonzalez for failure to maintain a condition of employment. See Gonzalez v. Dep’t of Agric., No. AT-0752- 22-0395-I-1 (“Gonzalez II”) (M.S.P.B. Dec. 16, 2022). We affirm.
Nassar v. Office of Personnel Management (Nonprecedential)
Jamil Nassar appeals from the final decision of the Merit Systems Protection Board (the “Board”) affirming the Office of Personnel Management’s (OPM’s) denial of Mr. Nassar’s application for disability retirement benefits under the Federal Employees’ Retirement System (FERS). Russell v. Dept. of the Air Force (Nonprecedential)
Stephanie Russell appeals the Merit Systems Protection Board’s final order, which sustained Ms. Russell’s removal from her position at Eglin Air Force Base. Because the Merit Systems Protection Board’s decision was in accordance with the law and supported by substantial evidence, we affirm.
