Today the Federal Circuit released a nonprecedential opinion in a patent case affirming a grant of summary judgment of noninfringement, two nonprecedential orders transferring appeals, and two nonprecedential orders dismissing appeals. Here are the introductions to the opinion and transfers, along with links to the dismissals.
DoggyPhone LLC v. Tomofun LLC (Nonprecedential)
DoggyPhone LLC appeals the U.S. District Court for the Western District of Washington’s grant of Tomofun LLC’s non-infringement summary judgment motion. Because we agree there is no genuine dispute of material fact, we affirm.
Pennant v. Department of the Air Force (Nonprecedential Order)
Genise A. Pennant petitions this court to review the final decision of the Merit Systems Protection Board affirming her removal and rejecting her affirmative defense of discrimination based on disability. In response to this court’s show cause order, Ms. Pennant appears to argue in favor of this court’s jurisdiction, while the Department of the Air Force argues in favor of transfer.
McDermott v. Merit Systems Protection Board (Nonprecedential Order)
Lance McDermott seeks review of the Merit Systems Protection Board’s decision dismissing his involuntary retirement appeal alleging disability discrimination. In response to this court’s show cause order, the Board and the United States Postal Service urge transfer to district court; Mr. McDermott asks this court to retain jurisdiction.
