Court Week

This week is Court Week at the Federal Circuit. The court will convene 13 panels to hear 63 cases. Of the 63 cases, the court will hear oral argument in 41 cases. The Federal Circuit provides access to live audio of these arguments via the Federal Circuit’s YouTube channel. This month, three cases scheduled for oral argument attracted amicus briefs. Here’s what you need to know about these three cases.

ATS Ford Drive Investment, LLC v. United States

As explained in our argument preview, in this case the Federal Circuit will review a judgment of the Court of Federal Claims, which granted a motion for summary judgment in favor of the government against a takings claim.

Mark F. (Thor) Hearne II will argue for ATS Ford Drive Investment, LLC.

David S. Frankel will argue for the United States.

This argument is scheduled to be heard on Wednesday, November 6, in Courtroom 203 at 10:00 AM Eastern time.

Restem, LLC v. Jadi Cell, LLC

As we explained in our argument preview, in this case the Federal Circuit will review a judgment of the Patent Trial and Appeal Board in an inter partes review proceeding that found challenged claims not unpatentable.

Joseph J. Richetti will argue for the Restem, LLC.

Jed H. Hansen will argue for the Jadi Cell, LLC.

The argument is scheduled to be heard on Thursday, November 7, in Courtroom 402 at 10:00 AM Eastern time.

Teva Branded Pharmaceutical Products R&D, Inc. v. Amneal Pharmaceuticals of New York, LLC

As discussed in this case’s argument preview, the Federal Circuit will review a district court’s injunction requiring the delisting of five patents from the Food and Drug Administration’s Orange Book.
