Opinions

This morning the Federal Circuit released one nonprecedential opinion and three nonprecedential orders. The nonprecedential opinion comes in a patent case. Two of the nonprecedential orders transfer cases, while the third nonprecedential order is a dismissal. Here are the introductions to the opinion and the orders other than the dismissal, which we link.

Angel Technologies Group, LLC v. Meta Platforms, Inc. (Nonprecedential)

Angel Technologies Group, LLC (“Angel”) sued Meta Platforms, Inc. (formerly Facebook, Inc.), and Instagram, LLC (collectively, “Meta”) for infringement of certain patent claims relating to digitally tagging images. The United States District Court for the Central District of California granted Meta’s motion to dismiss, concluding that the asserted patents do not claim patent-eligible subject matter under 35 U.S.C. § 101. Angel Techs. Grp. LLC v. Facebook Inc., No. 21-cv-8459, 2022 WL 3093232 (C.D. Cal. June 30, 2022) (“Decision”). Also before this court is Meta’s unopposed motion to partially dismiss the appeal for mootness. ECF No. 58. For the reasons below, we dismiss-in-part the appeal and affirm-in-part the district court’s judgment.

Nehemia v. Office of Personnel Management (Nonprecedential Order)

In response to this court’s July 2, 2024 order directing the parties to address this court’s jurisdiction, Quito I. Nehemiah moves to transfer the case to district court and the Director of the Office of Personnel Management agrees that transfer is appropriate. The motion to transfer is granted to the extent that this
matter and all case filings are transferred to the United States District Court for the District of New Mexico pursuant to 28 U.S.C. § 1631.

Martinez v. Army (Nonprecedential Order)

In response to this court’s July 18, 2024 order, the Department of the Army argues for transfer. Rudolph Martinez, Jr. moves at ECF No. 15 for leave to file his response out of time, asserting that this court has jurisdiction. ECF No. 15 is granted, and this matter and all case filings are transferred to the United States District Court for the District of Colorado pursuant to 28 U.S.C. § 1631.
