Here is an update on recent en banc activity in patent cases at the Federal Circuit. All we have to report is one new petition raising a question about minimum contacts for establishing personal jurisdiction. Here are the details.
New Petition
A new petition for rehearing en banc was filed in SnapRays v. Lighting Defense Group LLC. Lighting Defense Group asked the en banc court to review the following question:
- “Whether a patentee subjects itself to specific personal jurisdiction anywhere a plaintiff operates—even though the patentee has no contacts with the forum or the plaintiff—just because the patentee’s out-of-forum conduct has effects on plaintiff in the forum state.”
