Here is a report on recent news and commentary related to the Federal Circuit and its cases. Today’s report highlights:

  • a news release discussing how Federal Circuit Judge Richard Linn has been “selected to receive the prestigious 2024 American Inns of Court Professionalism Award for the Federal Circuit”; and
  • an article highlighting a pending case at the Federal Circuit in which the court will review a judgment of the Patent Trial and Appeal Board in an interference proceeding concerning competing patent applications related to the CRISPR-Cas9 gene-editing system.

Business Wire picked up a news release from the American Inns of Court discussing how Federal Circuit Judge Richard Linn has been “selected to receive the prestigious 2024 American Inns of Court Professionalism Award for the Federal Circuit.” The news release explains that “Linn received this recognition from his peers not for his work as a judge but for his decades-long commitment to promoting American Inns of Court focused on intellectual property.”

Matthew Dowd, Robert Scheffel, and Elliot Gee wrote an article for IPWatchdog highlighting a pending case at the Federal Circuit, Regents of the University of California v. Broad Institute, Inc., in which the court will review a judgment of the Patent Trial and Appeal Board in an interference proceeding concerning competing patent applications related to the CRISPR-Cas9 gene-editing system. The authors remark how in this case “the Federal Circuit faces a momentous decision: Affirm the PTAB’s (Patent Trial and Appeal Board’s) status as an international outlier–thereby denying the Nobel Prize winners–or reverse the PTAB, which can be equally challenging.” The authors indicate they wrote this article “mainly to highlight how this appeal has even broader implications beyond the significance of the groundbreaking technology.” We recently provided an argument preview for this case, which was argued last week.
