Today the Federal Circuit released a precedential opinion in a government contract case and a nonprecedential opinion in a pro se case. The court also released two nonprecedential orders granting summary affirmances. Here are the introductions to the opinions and links to the orders.

Nova Group/Tutor-Saliba v. United States (Precedential)

Nova Group/Tutor-Saliba (“NTS”) appeals from the judgment of the United States Court of Federal Claims that NTS failed to demonstrate it was entitled to recover additional compensation for alleged differing site conditions it encountered during the performance of a construction contract. We affirm.

Lemon v. Office of Personnel Management (Nonprecedential)

William H. Lemon petitions for review of the final decision of the Merit Systems Protection Board (“Board”) that affirmed the decision of the Office of Personnel Management (“OPM”) that Mr. Lemon was not eligible to receive annuity benefits under the Federal Employees’ Retirement System (“FERS”). Suppl. App. 1. We have jurisdiction pursuant to 28 U.S.C. § 1295(a)(9). For the reasons set forth below, we affirm.
