This morning the Federal Circuit released a precedential opinion in a patent case appealed from the Patent Trial and Appeal Board. The court affirmed the Board’s rejection of patent claims based on lack of subject matter eligibility. The Federal Circuit also released a nonprecedential order dismissing an appeal. Jeffrey A. Killian appeals from the decision of the Patent Trial and Appeal Board (Board) affirming the examiner’s rejection of claims 1, 5–8, 12–15, 19, 20 and 22 (all pending claims) of U.S. Patent Application No. 14/450,042 (’042 application) under 35 U.S.C. § 101. See Ex Parte Jeffrey A. Killian, No. 2020-003680, 2021 WL 363335 (P.T.A.B. Feb. 1, 2021). We affirm.
