Here is an update on recent en banc activity at the Federal Circuit. Since our last update, the Federal Circuit denied two petitions for en banc rehearing in patent cases that raised questions related to claim construction and the Administrative Procedure Act. The Federal Circuit also invited a response to a petition raising questions about unfair competition claims under the Lanham Act. Here are the details.

This morning, the Federal Circuit released four nonprecedential opinions. Two arose from challenges to decisions of the Merit Systems Protection Board. One came in a pro se appeal from a decision of the Court of Federal Claims. The final opinion addressed an appeal from a decision of the Court of Appeals for Veterans Claims. The Federal Circuit also released one Rule 36 summary affirmance, three nonprecedential orders dismissing appeals, and one nonprecedential order granting summary affirmance.
