Here is a report on recent news and commentary related to the Federal Circuit and its cases. Today’s report highlights:

• a blog post about the “high-stakes patent dispute between VirnetX and Apple” highlighting “VirnetX’s new petition asking the Supreme Court to review two important Federal Circuit rulings”; and

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. With respect to granted cases, there is no new activity to report since our last update. With respect to petitions, two new petitions were filed with the Court. One came in a patent case addressing both joinder in inter partes review proceedings and the Federal Vacancies Reform Act. The other came in a case addressing the Fair Labor Standards Act. Additionally, three waivers of right to respond were filed in the same patent case, and a brief in opposition was filed in another patent case addressing joint inventorship. Finally, the Court denied nine petitions in three patent cases, a trade case, and five pro se cases. Here are the details.

This morning, the Federal Circuit released two nonprecedential opinions, one in a patent case addressing obviousness and one addressing jurisdiction in a case involving an appeal from the Court of Federal Claims. The Federal Circuit also released two nonprecedential orders, one transferring a case to a district court and another dismissing an appeal. This morning, the Federal Circuit released two precedential opinions and two nonprecedential opinions. In the first precedential opinion, the court affirmed a judgment of the Patent Trial and Appeal Board. In the second precedential opinion, the Federal Circuit affirmed a judgment of the International Trade Commission. In the first nonprecedential opinion, the Federal Circuit vacated and remanded a judgment of the Eastern District of Texas in a patent case with instructions to dismiss the case as moot. Late yesterday and this morning, the Federal Circuit released a nonprecedential opinion and four nonprecedential orders. In the opinion, the court affirmed a judgment appealed from the Patent Trial and Appeal Board. The four nonprecedential orders dismiss appeals. • a first article concerning “the importance of adhering to local rules on initial disclosures in Delaware” after the Federal Circuit affirmed the dismissal of a patent case;
• a second article about Apple potentially escaping a $576 million judgment against it in a patent case; and
• a third article discussing the Federal Circuit’s reopening to the public yesterday.

This morning the Federal Circuit released a precedential opinion in a patent case appealed from the District of Massachusetts. The opinion vacates and remands based on the finding of an incorrect claim construction ruling by the district court. The Federal Circuit also released two nonprecedential orders. The first order deconsolidates cases appealed from the Patent Trial and Appeal Board, dismisses some of the cases, and informs the parties how they are to proceed on the remainder of the cases. The second order summarily affirms a dismissal by the Court of Federal Claims of a case for failure to pay the docketing fee. Here are the introductions to the opinion and orders.

VirnetX Attacks Apple’s PTAB Win At Fed. Circ. – Andrew Karpan reported for Law360 on VirnetX’s attempt to overturn a Patent Trial and Appeal Board ruling that if affirmed would undermine its $576 million patent infringement judgment against Apple.

Marathon, Others Defend Patent Case Fee Award at Federal Circuit – In her article on Bloomberg.com, Perry Cooper discusses a three judge panel of the Federal Circuit who “listened to arguments about a $5 million attorneys’ fee award in a fracking patent case.”

• Three Damages Questions for the Supreme Court – Cochlear Corp. petitioned the Supreme Court to review the Federal Circuit’s damages decision and recently received an amicus brief in support.
• Threshold Issues, Misdirected Lawyering, and a Frustrated Federal Circuit – Earlier this October, the Federal Circuit remanded AntennaSys, Inc., v. AQYR Technologies, Inc. to resolve the claim construction issues left undecided by the lower court and expressing their disdain towards unhelpful arguments from both parties.
