Opinions & Orders – May 4, 2023

This morning, the Federal Circuit released a precedential opinion in a case appealed from the Court of Appeals for Veterans Claims. In the opinion, the Federal Circuit explains why it dismissed the appeal for lack of jurisdiction. Recent Supreme Court Activity

Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. With respect to granted cases, there is no new activity to report since our last update. With respect to petitions, no new petitions were filed with the Court, but the government waived its right to respond in a pro se case; the Solicitor General filed a brief in opposition in two patent cases and another brief in opposition was filed by a private party in one of the same cases; two amicus brief were filed in another patent case, four amicus briefs were filed in a veterans case, and one amicus brief was filed in another patent case; and the Court denied certiorari in a patent case. Update on Important Panel Activity

Opinion Summary – Apple v. Vidal

Last week, the Federal circuit issued its opinion in Apple Inc. v. Vidal. In this case, the Federal Circuit reviewed a determination by a district court that 35 U.S.C. § 314(d) precluded judicial review of certain factors (the so-called Fintiv factors) adopted by the Director of the Patent and Trademark Office to govern decisions whether to institute inter partes review of patents. In an opinion authored by Judge Taranto and joined by Judges Lourie and Stoll, the Federal Circuit affirmed in part, reversed in part, and remanded. Late yesterday and this morning, the Federal Circuit released one precedential opinion, two precedential opinions, and five nonprecedential orders. In the precedential opinion, the court affirmed a judgment of the Court of Appeals for Veterans Claims. In the first nonprecedential opinion, the Federal Circuit affirmed-in-part, vacated-in-part, dismissed-in-part, and remanded a case appealed from the Court of Appeals for Veterans Claims. In the second nonprecedential opinion, the Federal Circuit affirmed a dismissal in an appeal from the Court of Federal Claims for lack of jurisdiction.
