Late yesterday and this morning, the Federal Circuit issued two nonprecedential opinions, three nonprecedential orders, and three Rule 36 judgments. In the first nonprecedential opinion, the court affirmed a judgment appealed from the Merit Systems Protection Board. In the second nonprecedential opinion, the Federal Circuit dismissed an appeal from the Court of Appeals for Veterans Claims for lack of jurisdiction. This morning the Federal Circuit released three nonprecedential opinions. The first and second opinions come in cases appealed from the Court of Federal Claims and involve issues related to the Vaccine Act and jurisdiction, respectively. The third opinion comes in a patent case appealed from the Patent Trial and Appeal Board. The Federal Circuit also released two nonprecedential orders late yesterday and this morning. One transfers an appeal to the Northern District of Illinois, and the other dismisses an appeal. Finally, the Federal Circuit released two Rule 36 judgments. This morning the Federal Circuit released one precedential opinion and two nonprecedential opinions. The precedential opinion comes in a patent case appealed from the Eastern District of Texas. In it, the Federal Circuit affirmed the district court’s determination that a patent is unenforceable based on prosecution laches. Notably, Judge Stark filed a dissenting opinion. The two nonprecedential opinions come in separate patent cases appealed from the Patent Trial and Appeal, both involving the same parties. In each opinion, Judge Lourie filed additional views and Judge Stark filed a concurring opinion, both addressing the argument the Supreme Court overruled the Federal Circuit’s approach to obviousness with respect to design patents. Here is an update on recent activity at the Supreme Court in cases decided by the Federal Circuit. With respect to granted cases, there is no new activity to report since our last update. With respect to petitions, two new petitions were filed, both in pro se cases; the government waived its right to respond in two other pro se cases and a Merit Systems Protection Board case; the government filed a brief in opposition in a veterans case; three petitioners filed reply briefs in three takings cases; two amicus briefs were filed in a veterans case and one amicus brief was filed in a patent case concerning inter partes review estoppel; and, finally, the Court denied three petitions, one in a judicial disqualification case and two in pro se cases. The Federal Circuit released four precedential opinions: a precedential opinion in a patent case decided by the Western District of Washington; two precedential opinions in cases addressing the Fair Labor Standards Act; and another precedential opinion addressing the Border Patrol Agent Pay Reform Act and Back Pay Act. Notably, in the latter three cases, Judge Reyna filed dissenting opinions. The court also released two nonprecedential opinions in cases involving the same appellant challenging decisions of the Merit Systems Protection Board, along with four orders dismissing appeals. This morning the Federal Circuit released a precedential opinion in a patent case appealed from the Patent Trial and Appeal Board. In this opinion, the Federal Circuit affirms the Board’s decision that specific claims are unpatentable, reversed the Board’s construction of the phrase “used for electrical interconnection,” and remanded the case. The Federal Circuit also released three nonprecedential opinions. The first comes in a case appealed from the Merit Systems Protection Board; the second comes in a patent case appealed from the District of Delaware; and the third comes in a government contract case appealed from the Court of Federal Claims. Finally, the Federal Circuit released two nonprecedential orders. One transfers an appeal to the Court of Appeals for the Second Circuit, and one transfers an appeal to the District of Maryland.
